A New Mexico judge just dismissed criminal charges after finding prosecutorial misconduct tainted the grand jury process.
The defendant had been indicted on criminal sexual-contact charges.
But the judge found prosecutors improperly interfered with the grand jury’s ability to hear potentially important witness testimony…
Conduct he characterized as serious enough to undermine the indictment.
The charges are dismissed for now, although prosecutors could try again with a new grand jury.
It’s a useful reminder that what happens before an indictment is returned can sometimes become the most important fight in the case.
