The Fifth Circuit just agreed to rehear a major felon-in-possession case en banc.

Peter Villa Cordova was convicted under 18 U.S.C. § 922(g)(1) after prior convictions for drug possession and evading arrest in a vehicle.

A three-judge panel upheld the gun conviction earlier this year.

Now the full Fifth Circuit has vacated that panel ruling and agreed to reconsider the case.

The here question is a big one:

How far can the government go in permanently disarming defendants whose prior felonies were not inherently violent?

The answer could reshape as-applied Second Amendment challenges across the circuit.
